Special Uses

Zoning districts typically permit certain uses as rights and other named uses as special exceptions. If designated a right, you can proceed with your plans. When you comply with setbacks, height, and other details, zoning administrators must approve your intentions (unless they find a loophole of their own to use against you—or your plans). If the use is classified within the special exception category, zoning officials could deny (or modify) your plans (see Table 8.2). They would have to object because your use would harm the public interest or create adverse effects for neighboring property owners.

Fortunately, owners can appeal the authority’s objection. And (in the United States—but not necessarily in other countries) if you challenge the ruling in court, the judge will reverse the normal
